Situations That Enhance a D.U.I. Charge
Three children, sleeping in the back of your car will immediately enhance your punishments if you've been drinking and driving. While this may seem like a bad dream, it happens - and the consequences are not pretty. The following are other circumstances that are the arch nemesis' of drunk drivers:
- - Speeding 20-30 miles over the speed limit while DUI
- - Having a BCA of .20% greater than the legal limit
- - Prior convictions for DUI, DWI, OUI, OWI or a related drunk driving offense
- - The person driving under the influence is under 21 at the time of the offense
- - Refusing to submit to a chemical test of blood, breath, or urine when suspected of DUI/DWI
- - An accident, property damage, or injury arising out of a DUI/DWI case
- - If you've been drinking and driving and someone is injured in an accident, even if it's your passenger, many states will convict you of a felony DUI/DWI. Also, if there is a death related to a DUI/DWI case, the drunk driver can be charged with vehicular manslaughter or even murder.
Again, the punishments and specific laws very from state to state and county to county. But keep in mind, they are all severe. |
