How a Lawyer May Defend You

There are many ways in which a dedicated DUI lawyer can defend you if you've been charged with a DUI crime. First, the prosecution must prove that you, the defendant were in fact driving the car at the time of intoxication.

Another angle your lawyer may try to take lies in the arresting officer. If the officer did not have probably cause to stop, detain and arrest you, this may help your defense. The officer must also inform you of your Miranda Rights and Implied Consent Laws. Your lawyer may question the observations and opinions of the arresting officer to help in your defense.

Or they may call into question the results of your chemical testing. This may happen because there is a potential for inaccuracy of the tests (particularly in urine and breath tests). There are also several other factors that may be of importance to a DUI defense.
